These Terms govern your use of the Top-RSVP service ("the Service"), an event-invitation and RSVP platform. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The service
Top-RSVP lets event hosts build a guest list, send invitations over WhatsApp and SMS, collect RSVPs, and plan seating. Features available to you depend on the package you hold. We may add, change, or remove features over time.
2. Accounts
You must provide accurate details and keep your login credentials secure. You are responsible for all activity under your account and for the conduct of any helpers you invite to an event. You must be legally able to enter into a contract to use the Service.
3. Acceptable use
You may only message people who expect to hear from you about your event, and only with content that is lawful and not misleading, offensive, or harmful. You must comply with WhatsApp and SMS carrier rules and with anti-spam and privacy laws. We may suspend accounts that send unsolicited or abusive messages.
4. Guest data
You are the controller of the guest information you upload (names, phone numbers, and responses). You confirm you have a lawful basis to hold and message those contacts, and you will honour any request from a guest to be removed. We process this data on your behalf as described in our Privacy Policy.
5. Payments and packages
Paid packages add guest capacity and sending channels. Prices are shown before purchase and charged through our payment provider. Guest invitations are consumed as you add guests and are non-refundable; removing a guest frees the slot but does not refund the purchase. Taxes may apply.
6. Message delivery
Messages are delivered through third-party providers (such as Twilio and TextMe) and mobile carriers. We cannot guarantee that every message is delivered, as delivery depends on the recipient, their carrier, and platform rules outside our control.
7. Availability and changes
We aim to keep the Service available but do not guarantee uninterrupted operation. We may perform maintenance, and we may modify or discontinue parts of the Service with reasonable notice where practical.
8. Intellectual property
The Service, its software, and its design are owned by us and our licensors. You keep ownership of the content you upload and grant us the limited licence needed to operate the Service for you.
9. Disclaimers and liability
The Service is provided "as is" without warranties of any kind to the extent permitted by law. We are not liable for indirect or consequential losses, and our total liability is limited to the amount you paid us in the twelve months before the claim.
10. Termination
You may stop using the Service at any time. We may suspend or close accounts that breach these Terms. On termination we may delete your data after a reasonable retention period.
11. Governing law
These Terms are governed by the laws of the State of Israel, and the competent courts of Israel have exclusive jurisdiction, unless mandatory local law provides otherwise.
